RIGHT TO A FAIR TRIAL: HISTORY OF ONE PROCEEDING

In the article on the example of one trial of the Russian Empire at the beginning of the 19th century – the case of General Przhibyshevsky – the problems of realizing the right to a fair proceeding are considered. The reasons why the trial and its results were forgotten have been identified. Brief biographical information about the person involved in the process is given. The plot of the case and the key circumstances of the battle of Austerlitz in 1805 are described. The place of the Auditor General as a military judicial body in the system of the supreme authorities and administration of the Russian Empire and the role of its leader, Prince Salagov, are noted. The course and results of the trial are briefly consecrated. It is concluded that the trial of General Przybyshevsky by the Auditor General is a case of typical justice for Russia.
