TRADITIONAL VALUES IN RUSSIAN JUDICIAL PROCEDURE

Abstract

The normative consolidation of traditional values has provided an opportunity to assess their impact on various branches of law. In addition to the guiding meaning for sectoral legislation, traditional values have a concrete embodiment in regulatory provisions. The article is devoted to the search for specific procedural norms in the legislation governing criminal, arbitration, civil and administrative proceedings that would realize the values of citizenship, patriotism, dignity, collectivity, justice, a strong family, the unity of peoples of Russia. A procedural manifestation of citizenship is the participation of society in the administration of justice, collectivism – collegial principles and group forms of participation in a case, patriotism – new grounds for suspending and terminating a criminal case, a strong family – witness immunity, the peoples of Russia unity – the rule on judicial proceedings not only in Russian, etc. A comparative analysis shows that the same values in universal procedural institutions and in similar procedures sometimes find different normative implementation. In some cases, traditional values are “competing”, in other cases, it is necessary to limit their absolutization in judicial procedures.
